Terms & Conditions

These Terms & Conditions govern your use of Photo Backup: External Drive (“Photo Backup,” “the App”), published by TechArm Softwares Inc. By downloading or using the App, you agree to these Terms and to our Privacy Policy.

The agreement governing your use of Photo Backup: External Drive.

1. Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and TechArm Softwares Inc. (“TechArm,” “we,” “us,” or “our”) concerning your download, installation, and use of Photo Backup: External Drive (the “App”). By downloading the App from the Apple App Store or using the App, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not download or use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility

You must be able to form a binding contract under applicable law and must comply with Apple’s App Store terms for your region. The App is intended for users who lawfully possess or are authorized to back up the media and files they process. You are responsible for complying with age-related App Store rules in your country.

3. License Grant

Subject to these Terms, TechArm grants you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules and Apple’s Licensed Application End User License Agreement (Standard EULA), except where a custom EULA expressly replaces provisions.

This license does not transfer ownership of the App’s software, trademarks, or documentation. All rights not expressly granted are reserved by TechArm and its licensors.

4. App Usage

Photo Backup enables you to:

  • Scan and back up Photo Library assets to Destinations you connect;
  • Run verified copies with cryptographic hash comparison (SHA-256) before marking items complete;
  • View backup history and progress;
  • Restore media to the Photo Library or export documents to folders you pick (as supported);
  • On the free tier: perform manual SSD/folder backup of the Photo Library, restore, and history as described in-product;
  • With Photo Backup Pro (via Apple In-App Purchase): unlock additional capabilities such as NAS (SMB), SFTP & WebDAV Destinations, AES-256 vault encryption, Files/document backup, multi-destination backup, local backup reminders, and on-device library tools (including duplicate detection, screenshot cleanup aids, storage analytics, face grouping, semantic search, trip detection, best-photo ranking, and auto albums).

Backups are initiated while you use the App (or opportunistically resumed under iOS background processing constraints). The App cannot promise silent, guaranteed backup whenever hardware is connected, because iOS does not provide a general “wake on USB insert” API for this purpose.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App to copy, distribute, or exfiltrate content you do not own or lack authorization to process;
  • Attempt to interfere with App integrity, Destination integrity of others, or Apple platform security;
  • Use the App to violate export controls, sanctions, or intellectual property rights;
  • Misrepresent affiliation with TechArm;
  • Probe, scan, or attack network Destinations without authorization;
  • Use the App in any manner that could damage, disable, or overburden third-party systems you do not control.

6. User Responsibilities

You are solely responsible for:

  • Granting and maintaining necessary iOS permissions;
  • Selecting trustworthy Destinations and safeguarding physical drives and network credentials;
  • Ensuring media and files you back up are lawfully held;
  • Keeping your Device OS updated;
  • Verifying that critical backups completed successfully;
  • Maintaining multiple independent backups of irreplaceable data (the classic 3-2-1 mindset: multiple copies, multiple media, off-site where appropriate);
  • Safely ejecting / disconnecting storage when prompted by iOS to reduce corruption risk;
  • Managing Apple ID subscriptions and cancellations.

7. Backup Responsibility

You remain responsible for maintaining your own backups. Photo Backup is a tool that assists verified copying to Destinations you control. It is not an insurance policy, escrow service, or guarantee against hardware failure, theft, ransomware on a NAS, accidental deletion, or user error.

TechArm Softwares Inc. does not take custody of your media and therefore cannot reconstruct lost libraries from TechArm servers.

8. Data Loss Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHARM IS NOT LIABLE FOR LOSS, CORRUPTION, OR UNAVAILABILITY OF PHOTOS, VIDEOS, DOCUMENTS, INDEXES, OR BACKUPS ARISING FROM, WITHOUT LIMITATION: failing drives; unstable USB hubs; improper disconnection; revoked security-scoped bookmarks; expired permissions; iCloud placeholders not downloaded; interrupted transfers; OS kills of background tasks; incompatible file systems; NAS/SFTP misconfiguration; encryption key loss; user deletion; malware on Destinations; or force majeure events.

The App attempts safe, verified copying, but cannot guarantee every file transfer under all hardware and network conditions. Always spot-check restores of critical memories.

9. External Drive Compatibility

Photo Backup supports Destinations that Apple’s Files framework and related APIs can expose to sandboxed apps. Real-world success depends on Device model, iOS/iPadOS version, cables, power, hubs, enclosure firmware, and file system format. Some drives that work on a computer may not mount reliably on iPhone/iPad.

You should verify compatibility with Apple’s documentation and your hardware vendor before relying on a particular drive for sole backup custody.

10. Unsupported Hardware

TechArm does not warrant support for every external accessory, card reader, RAID enclosure, or network appliance. Hardware that requires proprietary drivers unavailable on iOS, draws insufficient power, uses unsupported file systems, or fails Apple’s mounting requirements is outside the App’s supported scope. The iOS Simulator cannot substitute for physical external-storage testing.

11. File Integrity

Photo Backup’s verification engine is designed to compute SHA-256 of source bytes during read and SHA-256 of Destination bytes after write, marking a job complete only when hashes match. This materially reduces silent corruption risk compared with unchecked copies, but it does not eliminate all risk (for example, bit rot after successful verification, subsequent user modification, or storage failure).

Periodic re-verification and redundant Destinations remain your responsibility for long-term archival.

12. Restore Limitations

Restore depends on Destination availability, intact files, correct encryption keys (if Pro vault encryption was enabled), PhotoKit write permissions, and Apple API capabilities for metadata preservation. Some asset types (Live Photos, RAW pairs, edited derivatives) may restore with limitations inherent to platform APIs. Document restores write to folders you pick and do not automatically re-inject into other apps’ private containers.

Restoring does not guarantee pixel-perfect reconstruction of every historical edit state or album organization that existed only in Apple’s proprietary library structures.

13. Intellectual Property

The App, including its software, UI, design system, documentation, and branding (excluding your media and third-party open-source components), is owned by TechArm Softwares Inc. or its licensors and protected by copyright, trademark, and other laws. Your media remains yours. Open-source components are provided under their respective licenses.

15. Trademarks

“Photo Backup,” “Photo Backup: External Drive,” “Photo Backup Pro,” “MemoryVault” (internal/project branding), and TechArm Softwares Inc. names and logos are trademarks or trade dress of TechArm Softwares Inc. where claimed. Apple, App Store, iPhone, iPad, iOS, iPadOS, FileProvider/Files, and related marks are trademarks of Apple Inc., registered in the U.S. and other countries. No affiliation or endorsement by Apple is implied beyond App Store distribution.

16. Reverse Engineering

Except to the extent permitted by mandatory law or applicable open-source licenses, you may not reverse engineer, decompile, disassemble, or attempt to derive source code from the App, nor circumvent technical limitations, forge entitlement signals, or interfere with StoreKit validation.

17. Software Updates

TechArm may provide updates, patches, or new versions via the App Store. Updates may modify features, minimum OS requirements, or Pro gating. Failure to update may result in reduced compatibility with newer iOS releases or storage behaviors. These Terms apply to updates unless accompanied by separate terms.

18. Beta Features

From time to time, TechArm may offer experimental, preview, or TestFlight builds. Beta features are provided AS IS, may be unstable, may delete or alter local indexes, and may be withdrawn at any time. Do not rely on beta builds as your sole archival workflow for irreplaceable media.

19. Availability

Because the App is local-first, core backup functions do not depend on TechArm uptime. However, App Store delivery, StoreKit purchase validation, and network Destinations you choose may be unavailable due to Apple, your ISP, or your NAS/SFTP host. TechArm does not guarantee uninterrupted operation on every Device configuration.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHARM SOFTWARES INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHARM’S TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO TECHARM (IF ANY) FOR THE APP OR PRO SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE AS PLATFORM COMMISSION WHERE NOT RECEIVED BY TECHARM AS REFUNDABLE PRINCIPAL), OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the fullest extent permitted. TechArm is not responsible for corrupted drives, failed USB accessories, or data loss on Destinations outside our custody.

21. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TECHARM DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT ALL TRANSFERS WILL SUCCEED, THAT HASH VERIFICATION WILL DETECT EVERY POSSIBLE FAILURE MODE, OR THAT THE APP WILL BE COMPATIBLE WITH ALL HARDWARE.

Nothing in these Terms excludes warranties or consumer guarantees that cannot be excluded under mandatory law.

22. Indemnification

You agree to defend, indemnify, and hold harmless TechArm Softwares Inc. and its affiliates, officers, directors, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the App; (b) your violation of these Terms or law; (c) your infringement of third-party rights in media or files you process; or (d) your Destinations, networks, or credentials.

23. Force Majeure

TechArm shall not be liable for delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failures of public infrastructure, or failures of Apple platforms or third-party networks.

24. Export Compliance

You represent that you are not located in a country subject to a U.S., Canadian, or other applicable government embargo, and are not on any denied-party list. You agree to comply with all export and sanctions laws applicable to your use of cryptography-containing software and to Destinations you operate.

25. Termination

These Terms remain in effect until terminated. You may terminate by deleting the App and canceling any subscriptions through Apple. TechArm may terminate or suspend access to Pro features or distribution if you materially breach these Terms, if required by law, or if the App is removed from the App Store. Sections that by nature should survive (including ownership, disclaimers, limitations, indemnity, and governing law) survive termination. Termination does not entitle you to Destination data retrieval services from TechArm.

26. Governing Law

Except where mandatory consumer protection laws of your country of residence require otherwise, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to those mandatory protections, courts located in Ontario, Canada shall have exclusive jurisdiction over disputes arising from these Terms, unless Apple’s App Store terms require a different dispute forum for specific claims.

27. Consumer Rights

If you are a consumer, you may have non-waivable rights under the laws of your place of residence (including statutory warranties and cooling-off rights for digital content in some jurisdictions). These Terms do not exclude those rights. For App Store billing disputes, Apple’s refund policies often apply in the first instance.

28. Apple’s Standard EULA & App Store Terms

Your use of the App is also subject to Apple’s Licensed Application End User License Agreement (Standard EULA) available at Apple’s legal site, and the App Store Terms of Service / Usage Rules applicable to your Apple ID region, except to the extent TechArm provides these custom Terms which may supplement or replace the Standard EULA as permitted by Apple.

Without limiting Apple’s Standard EULA:

  • The license is limited to a non-transferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules;
  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. TechArm is solely responsible for maintenance and support to the extent described herein or required by law;
  • Apple is not responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. To the maximum extent permitted, if any warranty remains, TechArm — not Apple — is responsible. Upon product warranty failure, you may notify Apple for a refund of the purchase price (if any) as permitted by Apple, and to the maximum extent permitted by law Apple has no other warranty obligation;
  • TechArm, not Apple, is responsible for addressing claims relating to the App, including product liability, legal compliance, consumer protection, or intellectual property infringement claims;
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms / the EULA. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary.

In-App Purchases, free trials (if offered), auto-renewable subscriptions, pricing, and cancellation are presented on the paywall and managed in Apple ID → Subscriptions (or account.apple.com). Photo Backup never charges outside the App Store for Pro entitlements.

29. iOS Permissions, Files Framework & External Accessories

You acknowledge that Photo Backup relies on iOS permissions and frameworks, including:

  • Photo Library read/add permissions via PhotoKit;
  • User Notifications for optional local reminders;
  • Files framework / UIDocumentPicker and security-scoped bookmarks for Destinations and Pro file sources;
  • Network APIs for Pro SMB/SFTP/WebDAV Destinations;
  • External accessory / USB storage exposure as provided by Apple’s platform — TechArm does not bypass sandboxing.

Revoking permissions, denying folder access, or using unsupported accessories may prevent backups. You agree that such platform constraints are not a breach by TechArm.

30. Third-Party Services

The App may interoperate with Apple services and with Destinations or libraries operated by third parties (NAS devices, SFTP hosts, WebDAV servers, open-source packages). TechArm does not control third-party terms, availability, or security. Your use of third-party services is at your own risk and subject to those parties’ terms.

31. Photo Backup Pro Subscriptions

Photo Backup Pro is an optional auto-renewable subscription (for example monthly and yearly product identifiers offered via StoreKit) that unlocks Pro features described in-product. Payment is charged to your Apple ID. Subscriptions renew unless canceled at least 24 hours before the end of the current period (or as otherwise required by Apple’s rules). Manage or cancel in Apple ID settings. Free-tier SSD/folder Photo Library backup, restore, and history remain available without Pro as described in the App.

Pro is not a TechArm-hosted cloud storage plan. Canceling Pro may disable Pro Destinations and library tools while leaving your Destination files intact on hardware you control.

32. Entire Agreement

These Terms, together with the Privacy Policy and any in-App disclosures legally incorporated by reference (including subscription pricing shown at purchase), constitute the entire agreement between you and TechArm regarding the App and supersede prior understandings on that subject, without limiting Apple’s separate agreements with you.

33. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

34. Waiver

Failure by TechArm to enforce any provision shall not constitute a waiver of future enforcement. Any waiver must be in writing to be effective.

35. Assignment

You may not assign or transfer these Terms without TechArm’s prior written consent. TechArm may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms bind permitted successors and assigns.
